Terms of Service

These Terms of Service (“Terms”) govern your use of the PupSmith online store and your purchase of products from PupSmith LLC, a New Mexico limited liability company (“PupSmith,” “we,” “us,” or “our”). By accessing the store or placing an order, you agree to these Terms and the policies linked from the store. If you do not agree, do not use the store.

Eligibility and acceptable use

You must be at least the age of majority where you live, or use the store with the involvement of a parent or legal guardian. You agree to provide accurate, current information and not to misuse the store, interfere with its security, introduce harmful code, scrape or copy content without permission, violate another person’s rights, or use the service for unlawful or fraudulent activity.

Store information and products

We work to present product descriptions, materials, dimensions, colors, images, availability, and prices accurately. Screens and handmade or small-batch production can produce reasonable differences in color, finish, texture, or dimensions. We may correct errors, update information, limit quantities, change or discontinue products, or cancel an affected order. Product availability is not guaranteed until an order is accepted.

Choose products appropriate for your dog’s size, health, behavior, and environment. Follow the product page, packaging, cleaning, and care instructions; supervise use; inspect items regularly; and discontinue use if an item becomes damaged. PupSmith products are not designed for unsupervised chewing. Ask a veterinarian when you have a health or safety concern. No consumer product can eliminate every risk, and you remain responsible for reasonable supervision and product selection.

Orders, prices, and payment

Your order is an offer to purchase. An automated confirmation means we received the order, not that we accepted it. We may accept, reject, limit, or cancel an order for reasons including availability, suspected fraud, pricing or description errors, shipping restrictions, or payment problems. If we cancel after charging you, we will refund the canceled amount.

Prices are shown in U.S. dollars unless stated otherwise. Shipping, taxes, discounts, and other charges are shown at checkout when applicable. You authorize Shopify and the selected payment provider to charge the payment method submitted for the full order total. You represent that you are authorized to use that method.

Shipping, returns, and refunds

Our Shipping Policy and Refund Policy are incorporated into these Terms. We do not publish a guaranteed delivery date, and any transit time a carrier shows is that carrier's own estimate; delivery can be affected by carriers and events outside our control. Title and risk of loss pass as provided by applicable law. Nothing in these Terms limits a nonwaivable consumer right.

Promotions and gift cards

Discounts, giveaways, subscriptions, preorders, and other promotions may have additional terms. Unless we say otherwise, discounts cannot be combined, have no cash value, and may be changed or ended before an order is accepted. Gift cards are governed by the terms shown when purchased and applicable law.

Intellectual property

The store and its text, product names, original designs, photographs, graphics, logos, videos, code, and other content are owned by PupSmith or used with permission and are protected by intellectual-property laws. We grant you a limited, personal, nonexclusive, revocable right to use the store for lawful shopping. No other license is granted. You may not reproduce, distribute, modify, sell, or commercially exploit our content without written permission.

Reviews and other submissions

If you submit a review, photo, suggestion, or other content, you confirm that you have the right to share it and that it is accurate, lawful, and does not violate anyone’s rights. You give PupSmith a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content in connection with our business. We may moderate or remove submissions but are not required to do so.

Third-party services and links

Shopify and other providers support parts of the store. Third-party tools, payment methods, carrier sites, and external links may have separate terms and privacy practices. We are not responsible for third-party sites or services we do not control. Review their terms before using them.

Disclaimers

To the fullest extent permitted by law, the store and its content are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement, except where a warranty cannot legally be excluded. We do not promise uninterrupted or error-free access. Product warranties, if any, are limited to those expressly stated on the product page or required by law.

Limitation of liability

To the fullest extent permitted by law, PupSmith and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages, or lost profits, revenue, data, or goodwill, arising from the store, a product, or these Terms. Our total liability for a claim will not exceed the amount you paid PupSmith for the product or order giving rise to that claim. These limits do not apply where prohibited or to liability that cannot legally be limited.

Indemnity

To the extent permitted by law, you agree to indemnify and hold PupSmith harmless from third-party claims, losses, and reasonable costs arising from your unlawful misuse of the store, your violation of these Terms, or content you submit. This does not apply to claims caused by PupSmith’s own unlawful conduct.

Governing law and disputes

New Mexico law governs these Terms, without regard to conflict-of-law rules, except where the law of your home state must apply. Before filing a claim, you and PupSmith agree to make a good-faith effort to resolve it informally by written notice. Subject to any nonwaivable right to bring a claim elsewhere or in small-claims court, disputes will be handled by state or federal courts located in New Mexico, and the parties consent to their jurisdiction.

General terms

If a provision is unenforceable, the remaining provisions stay in effect. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a business reorganization or sale. These Terms and the incorporated policies are the complete agreement about the store and replace prior discussions on that subject.

Changes and contact

We may update these Terms by posting a revised version with a new effective date. Changes apply prospectively unless law requires otherwise. Questions may be sent to support@pupsmith.com. PupSmith LLC is located in New Mexico, USA.
